OB cell-phone robber set to be sentenced

The sentencing of an Ocean Beach man for robbing two 14-year-olds of their cell phones at knifepoint has been rescheduled for Jan. 22. Gibran Torres Perez, 19, was on probation at the time of the robbery for a stabbing on Newport Avenue that was linked to him earlier in 2012. Perez could get up to four years in prison under a plea agreement he made with San Diego Superior Court Judge Dwayne Moring, according to court records. It’s possible he could get probation with a one-year jail term. The robberies were committed on Oct. 29 and he sold both cell phones before he was arrested on Oct. 31. Perez was on probation for an April 14, 2012 incident in which a 20-year-old man was stabbed with some type of metal tool. Perez pleaded guilty to felony assault in that earlier incident, in which he exchanged harsh words with the victim on Newport Avenue near Bacon Street. The victim suffered injuries to his neck, hands and head. Perez was sentenced to 180 days in jail and fined nearly $500 in that incident. His probation has since been revoked. He could receive more jail time for violating probation, but records indicate the judge may impose only a concurrent sentence for the violation. The earlier incident occurred when Perez had been drinking, according to court records. He was ordered not to drink alcohol for three years on probation. He remains in custody without bail.
