SAN DIEGO COURT — A burglar who allegedly followed a La Jolla woman home from a beach party and stole property was sentenced Dec. 10 to one year in jail and three years’ probation. His friend is awaiting a Feb. 10 trial on a charge of sexually assaulting the victim in her bed. The burglar, Xavzier Pernell Paschal, 21, of San Diego, is serving his sentence at the George Bailey Detention Facility. County sheriff’s officials said, however, that Paschal is set for release Feb. 8 for the four months’ of credit from time served in jail since his arrest Aug. 11. Paschal allegedly took the woman’s cell phone, computer and iPod, but those items were recovered by a San Diego police officer who pulled over a vehicle on Nautilus Avenue minutes later after the victim called 9-1-1. San Diego Superior Court Judge Charles Gill fined Paschal about $1,000 and ordered that he not contact the victim. Paschal pleaded guilty Nov. 2 to burglary and receiving stolen property. No sexual assault charges were filed against him. Bryan Patrick Silva, 21, has pleaded not guilty to sexual assault upon an unconscious person and sexual battery in connection with the case. The 22-year-old victim woke up at 4 a.m. and discovered a hooded man touching her. She told police she screamed and that both men fled the residence. Silva, of San Diego, remains free on $50,000 bond. If convicted, Silva faces nine years in prison. — Neal Putnam
