The preliminary hearing for a 73-year-old driver who is charged with killing three people on a sidewalk during a rainstorm near City College was delayed until Feb. 22 due to his health problems.

Craig Martin Voss remains on house arrest following the March 15, 2021, incident in which he struck 10 people, killing three men in a tunnel at 9 a.m. on B Street west of Park Boulevard.

His preliminary hearing was again delayed Oct. 24 until Feb. 22, 2023 in San Diego Superior Court. His health woes were detailed a year ago in court in which a judge was told he takes 10 medications for his heart, diabetes, nausea, depression, and other ailments, besides having a previous stroke.

Voss has pleaded not guilty to three counts of vehicular manslaughter in the deaths of Randy Ferris, 65, Walter Jones, 61, and Rodney Diffendal, 40, as well as injuring others who were in tents in homeless encampments in the tunnel.

Voss surrendered his driver’s license, and the judge released him from jail based on his promise to appear because of his high risk to get COVID-19 in jail at the time. His wife is working to support themselves in their South Park home.

Voss is a veteran and a judge said he was not a flight risk. Deputy District Attorney Cally Bright opposed his release from jail, noting a pipe with methamphetamine was found in his pocket. Bright had urged a $500,000 bond amount.

Voss remains free on house arrest under conditions of a device to monitor that he does not use illegal drugs.
