First sentencing in Pacific Beach slaying

Eight years in state prison was handed down Nov. 15 as the first sentencing of one of four men who were implicated in a shotgun slaying in Pacific Beach.
The sentence for Freddy Sosa, 38, was a “stipulated sentence” agreed upon earlier, said Deputy District Attorney Flavio Nominati regarding the Dec. 29, 2018, slaying of Marcanthony Mendivil, 44.
San Diego Superior Court Judge Fred Link gave Sosa credit for 370 days in jail, and waived all the court fines.  Restitution to the victim’s family will be determined later.
Sosa and Pedro Ramirez, 27, both pleaded guilty to voluntary manslaughter and felony assault on Oct. 18. Nominati said Ramirez will get eight years in prison on Jan. 10, 2020.
Carlos Yslas, 25, the man who fired two shotgun blasts at the victim, also pleaded guilty to voluntary manslaughter and admitted a 25-year enhancement that he personally used the shotgun in the crime. Nominati said Yslas will receive 27 to 30 years in prison when he’s sentenced Jan. 10.
The last person to plead guilty was the home’s occupant, Paul Charles Weinberger, 51, to assault with a firearm. Weinberger admitted he “aided and abetted” the others in the case.
Weinberger faces a sentence ranging from two to four years in prison. The incident took place in his home in the 2300 block of Wilbur Avenue and he had given Mendivil permission to stay there that night.
Weinberger is the only one of the four who posted $1 million bond and he will be sentenced Dec. 6.  Weinberger wasn’t home when the slaying occurred. Nominati said Yslas carried a shotgun in a bag upon entering the home at 1:45 a.m. and shot him twice while wearing a mask. The prosecutor said the gunman “executed him while he was in his bed.”
It was Weinberger who fainted at his arraignment after the judge set $10 million bail for him in Jan. The bail was later reduced to $1 million. The others all remain in jail without bail.
