A 22-year-old man who admitted to having unlawful sexual intercourse with a teenage girl in University City was sentenced Sept. 23 to the 365 days he has already served and was released from jail.
Erick Rojas, of San Diego, walked out of the George Bailey Detention Facility Tuesday with credit for time served. He was placed on three years’ probation by San Diego Superior Court Judge Robert O’Neill.
Rojas was ordered not to contact the victim, whom he had met at an apartment complex on Palmilla Drive, off Regents Road, on Feb. 25. He was initially charged with rape of an intoxicated person and five other forcible sex charges, but those were dropped when he pleaded guilty July 29 to having unlawful sex with a minor.
Rojas was told at his plea hearing that he could receive three years in prison for the sex case and a consecutive sentence of three years and eight months for violating terms of his probation for burglary in another case, Deputy District Attorney Trisha Amador said. He received a concurrent term of 365 days for violating probation, and that sentence was reinstated.
Rojas was convicted Jan. 3 of residential burglary in Chula Vista Superior Court. He was sentenced to the 373 days in jail that he had already served on that case.
