An armed, suicidal man who was shot by police in Mission Bay Park pleaded guilty April 13 to brandishing a weapon in the presence of a police officer in the Aug. 6, 2014 incident.
Lance Marshall Tamyo, 46, has agreed to accept a 180-day jail term and a suspended 4-year prison term, said Deputy District Attorney Michael Runyon.
Runyon said it is likely Tamyo will be placed on probation at his June 22 sentencing before San Diego Superior Court Judge Timothy Walsh. If he commits any violation of his probation terms, he will have to serve that 4-year term in prison, he added.
Tamyo posted $150,000 bond after he spent several months in jail after being released from a La Jolla hospital for his gunshot wounds. He’ll get credits from his time in jail.
On Aug. 6, Tamyo called 911 from his car, saying he was suicidal, had a gun and wanted to “commit suicide by cop.” Tamyo got out of his car and walked around a grassy area holding a gun. He allegedly pointed a gun at numerous officers and also at an overhead police helicopter. Tamyo continued pointing his weapon and was shot at 12:10 p.m. near De Anza Cove. Tamyo dropped his gun on the grass, but his hand was nearby.
Officers, using shields, advanced with patrol cars driving on the grass until an officer removed the gun away from Tamyo’s reach, and he was taken to a hospital.
