A judge found a man is mentally competent to stand trial for murder on Oct. 20 in the death of a man who was pushed into a train at the Old Town Trolley Station.
Criminal proceedings were reinstated on Oct. 20 against Ryan Mihael Rukstelis, 26, who is charged with killing Martin Andara, 68, on Jan. 1.
Attorneys submitted the matter to San Diego Superior Court Judge David Berry, who ruled he was mentally fit and he set a preliminary hearing for Nov. 12.
Rukstelis’ attorney told a judge he doubted his client’s mental competency on June 8, so a judge suspended criminal proceedings as required and appointed psychiatrists to evaluate Rukstelis in jail.
The train did not run over Andara, but he was pushed into the train as it was coming into the station and he sustained fatal injuries from being pushed back and forth by the moving train.
The incident occurred around 6:15 a.m. while Andara was on his way to work at a grocery store.
Deputy District Attorney Scott Pirrello described the incident as “a random, unprovoked attack.” Rukstelis fled on foot and was arrested nine hours later on Park Boulevard by San Diego Police.
Rukstelis remains in the George Bailey Detention Facility without bail.
