Drunk driver awaits sentence in Pacific Beach head-on crash

A drunk driver will be sentenced Jan. 28 for DUI in a fiery Pacific Beach crash that sent herself and three others to a hospital after she ran a red light on Garnet Avenue.
Rachel Julian Fogle, 41, who is also known as Rachel Ballesteros and Rachel Warren, faces a one-year jail term for driving under the influence of alcohol with injuries. Her blood/alcohol level tested .26, which is over three times the legal limit, according to court records.
Fogle ran a red light while driving a black Hyundai Elantra on Garnet Avenue in Pacific Beach at 1:55 p.m. on Sept. 9. She struck a white Toyota Camry, head-on which then struck a parked Chevrolet Malibu.
Surveillance cameras at 1344 Garnet Ave. captured the crash on video when she crossed the double yellow lines and struck the Toyota, injuring driver Harry Brooks, 68, who was placed in intensive car initially because of breathing issues and an artery puncture. Brooks’ passenger, Maria Wooten, 62, had bone fractures and pain, according to court records.
The crash also sent a relative, Joshua Fogle, 44, with a brain bleed and facial injures. The injured and Rachel Fogle herself were all taken to Scripps Memorial Hospital in La Jolla.
She was driving at the approximate speed of 50-60 mph when she drove through a red light, according to an arrest warrant affidavit. The speed limit on Garnet Avenue is 25 mph. Fogle’s vehicle also caught on fire and it was put out by firefighters.
DUI charges were filed Sept. 20 in San Diego Superior Court and she was arrested at her Chula Vista home. Rachel Fogle is free on $250,000 bond on condition she wears a SCRAM device that checks for alcohol consumption.
She pleaded guilty to driving with a measurable blood/alcohol level with injuries to three others. She will be sentenced by Judge Kathleen Lewis on Jan. 28. The maximum sentence is seven years in prison and a $70,000 fine if she violates probation, but she has agreed to accept up to a year in jail.
Fogle’s attorney acknowledged that she injured multiple victims and she initialed a form that said she has a prior DUI conviction.
