Michael Anthony Davee, 52, of Pacific Beach, pleaded guilty Monday to assault with a firearm in a 2016 incident in which he pointed a gun at a La Jolla woman after he scaled a wall to reach her condominium. Davee will be sentenced May 30 by San Diego Superior Court Judge Michael Groch who indicated the sentencing would range from either probation to up to three years in state prison.
Deputy District Attorney Samira Seidu said the maximum sentence is nine years in prison if he violates any term of probation if that is granted.
A La Jolla woman testified Nov. 30 that Davee, her ex-boyfriend, crawled between two trees and scaled a wall to reach her upstairs condominium balcony on La Jolla Boulevard and he pointed a gun at her on Sept. 22, 2016.
The woman testified in the preliminary hearing that she ran out the door with her dog after Davee also pointed the gun at his own head at one point. “He said he was going to hurt me or himself. I was shaking,” said the victim.
The guilty plea cancels the April 17 trial. Other charges of stalking, making a criminal threat, possession of a firearm and ammunition by a felon, disobeying a court restraining order, and resisting arrest will be dismissed. Davee remains in jail on $300,000 bail. He was later arrested at the Dana Resort in Mission Bay. The woman was not injured.
