Three people pleaded not guilty Sept. 6 to misdemeanor charges involving the Labor Day brawl in Pacific Beach. Five others will be arraigned next month.
No felony charges were filed against any of the 15 who were arrested for fighting and throwing bottles and cans at San Diego Police officers who called for back-up officers in riot gear. No officers were injured in the melee, which was fueled by alcohol use on the beach.
District Attorney spokesman Paul Levikow said the conduct of the ones arrested was reviewed and determined that no felony offenses were committed and hence no one was charged with felonies. City Attorney Michael Aguirre can only file misdemeanor charges, and he filed charges against eight of the 15 who were arrested.
All but three people posted bond within days of their arrests, and the three who could not do so were released from jail Sept. 6 after their arraignment by a San Diego Superior Court judge. They were ordered to return to court on Sept. 20.
Kenneth Warkocki, also known as Kenneth Warlock, 32, of Gig Harbor, Wash., was charged with misdemeanor assault on a police officer and resisting arrest. He allegedly threw beer cans at officers.
Andrew Terrell, 20, of Santee, was charged with making a threat to an officer and assault on a police officer. He was accused of throwing four to five beer cans at officers. In a brief press release, Aguirre said Terrell picked up a horseshoe stake in a threatening manner.
Ricardo Guzman, 23, of San Diego, allegedly threw a full can of beer at officers. He is charged with assault on a police officer and resisting arrest.
Charges were filed against Valent Rich, 24, Dylan Whitman, 26, Kalicocky Willie, 24, David Hull and Michael Kelly, ages unavailable. They were ordered to return to court on Oct. 15 and 16 for arraignment.
Charges may be filed against others who were released from jail, said Maria Velasquez, spokesperson for Aguirre. At press time, it could not be determined why charges were not filed against seven others who were arrested and later released.
